Within the segment, Jeff Dennis answered the 'question of the week.' How can GCs help board members and other executives protect themselves from liability in the event of a shareholder class action tied to a data breach?

Managing Partner Jeff Dennis quoted in Wall Street Journal, "Board-level Lessons from the Yahoo Shareholder Settlement"


A settlement filed on March 2 between Yahoo Inc and shareholders stipulated that Yahoo would be required to pay $80 million to plaintiffs harmed by data breaches occurring in 2013 and 2014. Newmeyer & Dillion Managing Partner Jeff Dennis spoke with reporter Kate Fazzini of WSJ Pro Cybersecurity about the settlement and provided insight on what it means for boards concerned about cyber risk.

“[Boards] must understand regulations, set and prioritize cyber initiatives with a focus on reporting and examine how they are managing external risk, including risk from third parties,” said Mr. Dennis, adding “The board doesn’t need to do day-to-day management, but it does need to set the agenda and tone at these companies so they understand cyberrisk is an important part of the business.”

The Slow Fade of the 'Breach Blame-Game'

Newmeyer & Dillion Managing Partner Jeff Dennis spoke with reporter Kate Fazzini of WSJ Pro Cybersecurity about the ‘breach blame-game’ following the testimony of former Equifax Inc. chief executive Richard Smith on the company’s breach.

“The time for CEOs and executives to place blame elsewhere is coming to an end,” said Mr. Dennis. “They are going to be held to an ever-higher standard of care when it comes to data protection and privacy.”
